EPA wetlands order can be challenged by land owners, Supreme Court rules

The US Supreme Court Wednesday ruled unanimously in favor of an Idaho couple seeking to have their day in court to challenge an Environmental Protection Agency order that scuttled plans to build their dream home on a subdivided lot the EPA said was a federal wetland.

The couple, Chantell and Michael Sackett, had started to fill the home site with dirt and gravel to prepare for construction. But the EPA intervened, announcing that the property was a regulated wetland. Agency officials ordered the couple to restore the land to its original state or face up to $75,000 a day in fines.

The Sacketts disputed the EPA?s wetland designation and filed a lawsuit to litigate the issue in federal court.

The EPA argued that the Sacketts? lawsuit must be dismissed because the EPA?s Clean Water Act compliance order did not amount to final agency action.

A federal judge and the Ninth US Circuit Court of Appeals agreed with the EPA and threw the suit out. Facing bankrupting daily fines and no clear avenue for judicial review, the Sacketts took their case to the Supreme Court.

In a unanimous decision on Wednesday, the high court said the Sacketts are entitled to challenge the EPA order in federal court.

?The Sacketts may bring a civil action [under the Administrative Procedure Act] to challenge the issuance of the EPA?s order,? Justice Antonin Scalia said in a statement from the bench announcing the decision. ?The APA provides for judicial review of final agency action for which there is no other adequate remedy in court,? he said.

The justices did not rule that the couple may proceed with construction of their home on the disputed tract. Instead, the high court decision sets the stage for a federal judge to examine the EPA order. In effect, the Sacketts won the opportunity to present their case to a neutral judge.

?We are very thankful to the Supreme Court for affirming that we have rights ? and that the EPA is not beyond the control of the courts and the Constitution,? Mr. Sackett said in a written statement.

?The EPA used bullying and threats of terrifying fines, and has made our life hell for the past five years,? Sackett said. ?It said we could not go to court and challenge their bogus claim that our small lot had ?wetlands? on it.?

He added: ?As this nightmare went on, we rubbed our eyes and started to wonder if we were living in some totalitarian country.?

The Supreme Court decision represents a victory for property owners faced with the prospect of EPA action that effectively seizes control of their land by declaring it a ?wetland,? said Damien Schiff, a lawyer with the Pacific Legal Foundation, which is representing the Sacketts.

?The justices have made it clear that EPA bureaucrats are answerable to the law and the courts just like the rest of us,? Mr. Schiff said in a statement. ?EPA will have to be prepared to show a reviewing court that its wetlands regulations are really necessary ? not just a power trip.?

At the heart of the dispute is a .63-acre lot near Idaho?s scenic Priest Lake that the Sacketts purchased in 2005 for $23,000.

After obtaining local permits in 2007, the couple began grading the property with soil and rock in preparation for construction of a three-bedroom home.

As the grading got underway, EPA officials arrived at the site and ordered the work to stop. They advised the Sacketts that the tract was a federally-regulated wetland and that the fill material was a form of pollution in violation of the Clean Water Act.

The Sacketts disagreed that their lot was a ?wetland? subject to federal regulation. The EPA responded by issuing a compliance order requiring them to immediately remove all fill material from the site and restore the property to its original condition. The order required the couple to plant new trees and shrubs and keep a fence around the lot for three growing seasons.

The Sacketts estimate the restoration would cost $27,000 ? four thousand dollars more than they paid for the property. The EPA also advised them that they would be fined up to $75,000 for each day the fill material remained on the lot.

The EPA told the couple they should have applied for a permit before they began construction. The Sacketts estimate the wetlands permit process might have cost as much as $200,000.

The Sacketts asked for an administrative hearing. The agency refused. That?s when the couple filed their federal lawsuit asking a US district judge to determine whether their land was, in fact, a federally-regulated wetland.

The judge dismissed the case. That decision was upheld by a federal appeals court panel.

The courts ruled that since the EPA?s action was just an administrative order ? rather than final agency action ? the Sacketts could not file a lawsuit. They would have to wait until the EPA filed a formal enforcement action against them.

On Wednesday, the Supreme Court reversed the lower court rulings and rejected the EPA?s position.

?We conclude that the compliance order in this case is final agency action for which there is no adequate remedy other than APA review, and that the Clean Water Act does not preclude that review,? Justice Scalia wrote for the court.

In a concurring opinion, Justice Samuel Alito urged Congress to issue a more precise definition of which waters fall under federal regulation via the Clean Water Act. He said the current definition is ?notoriously unclear.?

The combination of murky definitions in the CWA and ?draconian powers? wielded by the EPA, ?still leaves most property owners with little practical alternative but to dance to the EPA?s tune,? Alito wrote.

?Allowing aggrieved property owners to sue under the Administrative Procedure Act is better than nothing, but only clarification of the reach of the Clean Water Act can rectify the underlying problem,? he said.

The case is Sackett v. Environmental Protection Agency (10-1062).

RealtyTrac VP Daren Blomquist cited the example of one house in the 2800 block of South Seventh Street in Philadelphia scheduled for sheriff?s auction Monday. The first notice of intent to foreclose against the borrowers was filed in June 2007. ?This is probably one of the more extreme examples, but there are plenty that have been sitting in the foreclosure pipeline for a year or two,? Blomquist said.?

The Express Times in Pennsylvania. ?Easton officials are looking for answers to stem an ongoing tide of properties becoming vacant through foreclosure. As foreclosures increase, Councilman Roger Ruggles said his attention is increasingly falling on banks as much as absentee landlords. ?What we find is many times banks are holding onto (foreclosed properties) because real estate prices are down now,? Ruggles said.?

The Herald Mail on Pennsylvania. ?Home building continued to plummet in Franklin County, Pa., in 2011. The county issued 179 permits in 2011, compared with 1,257 in 2006. Franklin County experienced a housing boom about five years ago, with some calling it the ?Mason-Dixon Challenge? as people who work in the Washington, D.C., and Baltimore areas moved north.?

?About 4,000 lots remain in limbo in various stages of Washington Township?s approval process, ranging from sketch plans to preliminary and final approval. Ronnie Martin, a Waynesboro-based Realtor and developer, said short sales and foreclosures are driving down the costs of all homes for sale. The average buyer, he said, is looking to spend no more than $1,000 a month for principal, interest, taxes and insurance. That means the typical buyer is looking to spend $130,000 to $170,000 on the home, Martin said.?

?The popularity of town houses in Franklin County declined when the Uniform Construction Code in Pennsylvania started requiring sprinkler systems in buildings with three or more units, Martin said. ?The problem is we?re not doing very well with the new law requiring sprinkler systems, which cost $5,000 a unit. That?s all the profit,? Martin said. ?You can?t absorb the cost, so we shut down and aren?t building anything,? he said.?

DFM News in Delaware. ?There are more homes available in Middletown than there are buyers. Deb Sullivan, a Middletown native and a RE/Max agent, says the home market was hit especially hard because so many buyers came in at the height of the housing boom, then parked two SUVs the driveway and built a pool in the backyard. ?It might have been their first home and it cost $400,000,? she says. ?The debt-to-income ratio was simply too high for many people.??

?Higher energy costs also are hurting home sales as prospective buyers weigh the cost of commuting to Wilmington or Dover. ?People aren?t looking for 5,000 square feet any more,? Sullivan says. ?They don?t want two-story family rooms because they worry about utilities.??

?McMansions will not be in reach for most of the new employees at Amazon. The company says more than 700 of the 849 workers will earn $11 an hour. Still, Sullivan believes new jobs will give both the home buying and rental markets a boost. ?These jobs will help us to sell less expensive homes, which means those owners will be able to move up,? she says.?

The Frederick News Post in Maryland. ?Frederick County had 55 foreclosures in February, according to RealtyTrac, down nearly 7 percent from January and down 15 percent from February 2011. ?It appears that foreclosures are coming on the market in small spurts and will not have a heavy flood anytime this year as the election is upon us,? said Darren Ahearn, an agent with Real Estate Teams in Frederick. ?They (lenders) do not want to have things get worse off than it has been overall.??

?Buzz Mackintosh of Mackintosh Inc. Realtors in Frederick said Maryland has roughly 23 months of ?shadow inventory,? homes that are near foreclosure or going through the distressed property process by lenders but will add to the market inventory eventually.?

The Virginian Pilot. ?Dotty Acampora is a foreclosure-prevention counselor at the nonprofit Virginia Beach Community Development Corp. She sat down with The Pilot recently to talk about where the region stands at this juncture. Q: Last year the number of foreclosures across the region fell from a high during 2010. Do you think Hampton Roads has seen the worst of the foreclosure crisis??

?A: Honestly, I don?t think we?ve gotten over the hill yet. Far from it. I think this year is probably the top of the hill. Now that the mortgage settlement has come to fruition - I got the recent issue of Inside Business, and I saw that the local foreclosure listings page had doubled at least in the number of sales posted.?

The Daily Press in Virginia. ?Hampton Roads home sales climbed nearly 21 percent in February, compared to February 2011, but about one in three of those sales, or 36 percent, were foreclosed homes or short sales. For months, there has been an oversupply of homes on the market, but that number?s coming down. Sheila Dann, president of the Virginia Peninsula Association of Realtors attributes the drawdown of the oversupply to people who are deciding not to sell if they can?t get as much as they want. Her advice for those sellers? ?If you don?t need to sell, don?t do it.??

The Gaston Gazette in North Carolina. ?Gaston County had more new home sales this January than during any January since 2008. People who know the industry would caution us not to stake too much on the improvement, however. The gain was slight, about four homes more than in the previous year. And the number remains far lower than the five-year peak, which totaled 80 homes in January 2008. ?The market for new construction is not there,? said Moises Miranda, a Gastonia Realtor and, in more robust times, housing developer who serves as president of the Gaston Association of Realtors.?

?Miranda was a partner in building 29 houses in 2003, in addition to around six townhouses. ?But there was a market back then,? he says.?

?Say it will cost you $15,000 for a piece of land and $70,000 to build a home on it. With so many foreclosures and short sales pulling down prices, you can probably buy that same house, or the 2005-built equivalent, for $70,000, ac-cording to Miranda. Miranda himself has a few lots just waiting for new houses. ?But if I build,? he says, ?I have no one to buy.??

The Chapel Hill News in North Carolina. ?Greenbridge, the 10-story condominium project heralded as the beacon of downtown Chapel Hill?s higher-rise future, was foreclosed, its managing partner said. Sales of units in the energy-efficient building were halted after the $60 million project ran $1.6 million over budget in 2010 and Bank of America wouldn?t pay the bills, partner Tim Toben said. Thirty-seven of 97 units had been sold.?

?Bank of America loaned the developers $43.25 million in 2008, Toben said. The developers, their friends and family members invested $17 million, which has all been lost, he said. ?It?s been incredibly painful to see a great project standing idle, while the world moves on,? Toben said in an email.?

The Brunswick Beacon in North Carolina. ?The fate of trees remains up in the air after a roomful of residents bombarded the manager of Carolina Shores Golf Course with questions. A resident asked whether the golf course is ?bankrupt or not?? Mayor Walter Goodenough banged the gavel and said it was not an appropriate question at this time. ?What the golf course owes in taxes has nothing to do with what we are doing or whether or not they?re going to get a permit to take trees down,? Goodenough said.?

?If the golf course?s tree-removal request is approved, another resident asked if that meant, ?in the future, if we want trees taken down simply to grow grass, we can do it?? ?You don?t want that golf course to fail,? Goodenough responded. ?And if it means taking down 1,000 trees or 500 trees or 10 trees, it?s beneficial to everybody over there that has homes that are valued at $200,000, $300,000 and $400,000. We as a town can?t let it fail. ??

?At the end of the two-hour meeting, residents continued to question how removal of trees would affect water absorption and flooding. ?Trusting in the golf course is definitely a difficult problem,? Teddy Altreuter said. ?We all know they?re in foreclosure.??

The High Point Enterprise in North Carolina. ?Although the economy is looking up and the housing market is following it, Guilford County is still behind. According to a report from the N.C. Housing Coalition, the average hourly wage in High Point is $12.56, about $1 less than the North Carolina average of $13.68. The average wage of a renter in the Triad is $11.71. With nearly 85,000 renters in the area, about 50 percent of them in and around the Triad do not earn enough to afford a two-bedroom unit at the Fair Market Rent.?

Astronomers using NASA's Hubble Space Telescope have found several examples of galaxies containing quasars, which act as gravitational lenses, amplifying and distorting images of galaxies aligned behind them.

Quasars are among the brightest objects in the universe, far outshining the total starlight of their host galaxies. Quasars are powered by supermassive black holes.

To find these rare cases of galaxy-quasar combinations acting as lenses, a team of astronomers led by Frederic Courbin at the Ecole Polytechnique Federale de Lausanne (EPFL, Switzerland) selected 23,000 quasar spectra in the Sloan Digital Sky Survey (SDSS). They looked for the spectral imprint of galaxies at much greater distances that happened to align with foreground galaxies. Once candidates were identified, Hubble's sharp view was used to look for gravitational arcs and rings (which are indicated by the arrows in these three Hubble photos) that would be produced by gravitational lensing.

Quasar host galaxies are hard or even impossible to see because the central quasar far outshines the galaxy. Therefore, it is difficult to estimate the mass of a host galaxy based on the collective brightness of its stars. However, gravitational lensing candidates are invaluable for estimating the mass of a quasar's host galaxy because the amount of distortion in the lens can be used to estimate a galaxy's mass.

The next step for the team is to build a catalog of "quasar-lenses" that will allow them to determine masses for a statistically significant number of quasar host galaxies and to compare them with galaxies without quasars. With the numerous wide-field surveys that will start in the near future or that are already started, hundreds of thousands of quasars will be accessible for looking for lensing effects.

The team involved in this research includes: F. Courbin, C. Faure, F. Rerat, M. Tewes, and G. Meylan (EPFL, Switzerland), S.G. Djorgovski, A. Mahabal (Caltech), D. Stern (JPL), T. Boroson (NOAO), D. Kidnapped Swiss couple escapes from Taliban

A Swiss couple kidnapped by the Pakistani Taliban last July has escaped and will return home soon, the Swiss foreign ministry said on Thursday after the two reached a military checkpoint near Pakistan's border with Afghanistan.

Olivier David Och, 31, and Daniela Widmer, 29, were kidnapped in Pakistan's southwestern province of Baluchistan and had been held by the Taliban in the North Waziristan region.

"A few minutes ago I was able to speak to Daniela and David, and yes, they are free. They are in a safe place," Swiss Foreign Minister Didier Burkhalter told a news conference. "Daniela and David said they managed to escape this morning."


He denied Switzerland had paid to secure the couple's freedom: "Switzerland does not pay ransoms, and Switzerland did not pay a ransom."

According to Swiss newspaper Neue Z?rcher Zeitung (link in German), a Pakistani intelligence official who wished to remain anonymous said the Swiss government did in fact pay a ransom. He told the paper the Pakistani government had also released prisoners in the exchange, but it was not clear how many.

A spokesman for the Pakistan Taliban, Ihsanullah Ihsan, said the group released the couple after a council of elders was convened, CNN reported.

Swiss authorities declined to give the full names of the pair, who were named by Pakistani media.

Pakistan Army spokesman Major-General Athar Abbas told Reuters the pair had reported to a checkpoint and were then questioned in Peshawar. Abbas refused to refused to say whether a ransom was paid for the couple's release, or if other demands kidnappers were met, NZZ reported.

According to intelligence sources in North Waziristan, the two were found at a military checkpoint on a main road in Miranshah, the region's main town, at about 5:30 a.m. and were then sent to the city of Peshawar by helicopter.

The Swiss foreign ministry said in a statement the couple would return to Switzerland as soon as possible.

Targets
Pakistan's Taliban had claimed responsibility for kidnapping the couple, who were seized in the Loralai district of Baluchistan on July 1. The two were traveling in their Volkswagen bus from India to Iran.

The pair pleaded for their lives in two videos released in October. In one video, Och addressed the Pakistani, Swiss and American governments in English, asking them to release Aafia Siddiqui, a Pakistani neuroscientist imprisoned in the United States, and Taliban fighters in Pakistan's custody. The Taliban also demanded millions of dollars in ransom from the Swiss government.

Kidnapping for ransom is relatively common in Pakistan, and although foreigners are not often targets, militants occasionally take foreigners hostage.

Two Western aid workers were kidnapped by gunmen in the central Pakistani city of Multan on Jan. 19. A British doctor working with the International Committee of the Red Cross was kidnapped in the southwestern city of Quetta on Jan. 5.

Warren Weinstein, an American aid worker, was kidnapped in the central Pakistani city of Lahore in August last year. Al-Qaida claimed responsibility for Weinstein's abduction in December.

So I was going to write an introduction about how much Joan & Jared's wedding reminded me of our own interfaith families and our wedding... and then I was looking at the pictures and realized that Jared is wearing exactly the same tie as David wore on our wedding day. And then I had one of those magic connection moments. Because what Joan says about building a life together from two cultures is so perfect (and the joke about Yankee thrift vs. more recent immigrant culture is particularly hilarious, given that those of us from long lines of WASP families were raised to never show your hand when spending money, ever). But, more than all that, the bits Joan says about finding joy, re-negotiating?family?relationships, and the real reason weddings are important is such foundational stuff. If you're planning, you can't skip this post. Really.

The most remarkable thing about our wedding day for me was the simple and unabashed joy of it.?This is noteworthy because so much of our wedding planning had involved careful thought, deliberate planning, and diligent organization. And, then, BAM. Joy. But, let me back up a little further lest I give the impression that joy = easy.

As I mentioned, Jared and I put a lot of careful thought and planning into our wedding. This is largely due to the fact that we are planners. (Trust me, we have the Google Docs to prove it.) But, we also embarked on this careful planning in order to thoughtfully address how best to put together our blended/hybrid wedding.

I come from a fairly traditional Filipino, Catholic family. Almost all the weddings in my family have taken place in Catholic churches as the celebration of the Sacrament of Matrimony. But, I am no longer a practicing Catholic and am preparing to be a Unitarian Universalist minister. Jared's family is mostly a-religious and weddings have pretty much been celebrated in a secular fashion.

Jared and I are also from completely different parts of the country. Jared's roots go back several generations in New England and much of my family ended up in Chicago, where I was born and raised, after my parents and a few aunts and uncles immigrated there from the Philippines in the 1970s.

Our very wise premarital counselor told us that she likes to think of any marriage as the coming together of distinct cultures. Given how different our backgrounds really are, Jared and I form a blended union to a T. What really mattered in our wedding planning, though, and what really mattered to us as a couple despite those differences,?was living out our shared, common values with thought and care because those values are the foundation on which our partnership is built.

Before even officially becoming engaged, we had talked about our desire to get legally married in a state that has already extended that right to gay couples. Jared is from Vermont, one of the first states to legalize gay marriage. Not only would getting married in Vermont honor our value of marriage equality, it also meant a lot to us to be able to celebrate our marriage in the place that has always held a special place in Jared's heart and has grown to in mine. So, we decided we would get married in parts. First, we would have a small civil ceremony in Vermont, where Jared is from, to get legally hitched. And then, we would have the full community celebration in Chicago with all our family and friends.

The brilliance of this plan, as it turned out, is that we got to have two weddings! Amazing! Jared did most of the planning for the civil wedding from figuring out what papers we needed to file, to securing a location for the ceremony (the inn across the street from where his great-grandparents had lived), and lining up an officiant (his great-uncle Harvey who had also married his mother and step-father). Our Vermont wedding happened while we were in the thick of planning for the "big" wedding. Our short and sweet civil ceremony turned out to have just the right mix of spontaneity, planning, seriousness, and levity.

While we were legally married at this point, we still viewed our wedding in Chicago as the wedding. The official point at which we would call ourselves husband and wife. As an aspiring minister, putting a lot of thought into the ritualistic elements of our wedding was right up my alley. We very much felt like we were treading on new waters as we mapped out the series of events that we would call "our wedding" and designed the ceremony itself. Authenticity mattered to us. Having the wedding that would be meaningful to us and at the same time would respect and connect with my family's traditions and rituals.

We asked the priest at my parent's Catholic church to conduct a Mass of blessing and thanksgiving the day before our wedding. At the Mass, the priest blessed me and Jared as well as the Filipino marriage symbols (the coins, veil, and cord) that would be used in the wedding the next day. We then held our ceremony in a Unitarian church presided over by a Unitarian minister, and we incorporated the Filipino wedding rituals that are typically found in a Catholic service into our ceremony.

Incorporating the Filipino wedding rituals into our ceremony was partly motivated by a sense of obligation and duty. Yet, we also wanted to do so in a way that reflected our own values and the meaning of marriage for us. With the help of some of our family as well as the internet, we researched the history and meaning of the symbols and the typical way in which they are introduced and incorporated into a marriage ceremony. Traditionally, the symbols draw upon a rather patriarchal understanding of the husband-wife relationship and the institution of marriage. We weren't down with this, so we adapted these rituals and wrote out our own descriptions that my younger brother read in our ceremony. This way, we felt connected to these family traditions while also making them meaningful to us and honoring our values.

Another big difference between our families is that Jared's family culture is imbibed with a kind of Yankee thriftiness. For them, DIY isn't just a hip new trend in craftiness, it's what you do because you don't have a lot of money and you know you can rely on your own ingenuity. For my family, achieving middle-class status as immigrants means not having to DIY. So, again we found a blended middle ground for our wedding especially for the decor. Jared's mom, who is a very talented artist, hand drew and painted beautiful table letters for the dinner tables (each letter stood for a plant or flower from the Midwest or Northeast). We hope to bind them into a children's alphabet book or hang them in a child's room one day.?Despite some reticence, I also convinced my father, who is a wonderful gardener, to plant some dahlias so that we'd have some home grown flowers to include in the bouquets and centerpieces. We also bought some flowers from an online wholesaler and Jared's mom and a good family friend put those all together.

Despite all our careful planning, the unexpected did occur. For us, the unexpected turned out to be the sea of emotions our wedding unearthed not just in us but in our families as well. Many of the messages we get about the significance of marriage focus on the father-daughter relationship as one that dramatically shifts. While that was certainly a part of the family system change happening with our wedding, the more dramatic relational dynamics were really between me and my mother. This shouldn't have been surprising to me, but it was one part of the whole wedding thing I just hadn't planned for. The emotional upheaval came to a head in a rather dramatic mother-daughter confrontation two days before the wedding, and then, many more tears of release were shed during the Mass that Friday. By Saturday morning enough tears had been shed that my mother and I were able to enjoy some quality time at the salon getting our hair and make-up done and settling back into our mother-daughter relationship albeit with a new way of loving each other.

All of this background is important because the main thing I learned through getting married was that our wedding, while clearly being about our union, was also about so much more than that.?It was also about growing up. Letting go and learning to embrace unexpected growth and change. It was about the joining of two people and two families and the effort and emotional engagement that entails. It was about forging new identities built on who we already are at our core.?Through our wedding, I learned that all the planning and preparation of timelines and budgets doesn't prepare you for the emotional significance of the event. What does prepare you is holding fast to the love at the center of that union and letting that love be your guide.

So when I entered the church that afternoon, all felt complete. And it was joy. Unexpected, unmistakable joy. Not easily come by. But ready and waiting.

France celebrates historic sweep of Oscars (+video)

'The Artist' won five Oscars last night, including the first Best Picture and Best Actor awards for France. 'Hugo' also won five awards.

A French film has never before won an Oscar for Best Picture. A French male has never won Best Actor.

Last night "The Artist" won both, in what became a clean-up night for the French film industry at the annual red carpet gala in America's Tinseltown.

The black-and-white silent film ? a throwback to a Hollywood golden age ? took five statuettes in all, topping ?The Descendants? for Best Picture.

The popular actor Jean Dujardin ? a former locksmith known mainly here for his low-budget comedic spy spoofs and expressive eyebrows ? edged out George Clooney and Brad Pitt for Best Actor. And relative unknown Michael Hazanavicius topped big names like Martin Scorsese for Best Director.

France also showed its enduring capacity for ?soft power? through the arts, as films like the fantasy special-effects ?Hugo,? set in a Paris train station, also won five Oscars. Woody Allen?s ?Midnight in Paris? was a Best Picture nominee.

?They must be going nuts in France right now,? quipped Oscar host Billy Crystal after actor Tom Cruise opened the envelope at the end of the evening to announce that ?The Artist? took the coveted Best Picture prize.

French TV journalists reporting live from Hollywood were slightly beside themselves after the best picture win, throwing their hands over their faces and repeating ?phenomenal!? and ?incroyable!?

But at 5:30 am here ? there?s a nine-hour time difference between Paris and LA ? there was no discernible Oscar noise, at least on the residential streets.

Instead, French woke to newspapers and media hailing the evening as historic. ?Never has a French film won so many US honors,? wrote Le Monde.

A good run for Europe

Oscar-wise, it's been a good run for Europe. The British film ?The King?s Speech? swept top honors last year, including Best Picture and Best Actor (Colin Firth), for a period depiction of the trials of Britain?s King George VI in surmounting a speech impediment on the eve of World War II.

In "The Artist" Mr. Dujardin plays George Valentin, a silent star with a pencil-thin mustache who can?t or won?t make the transition to talkies, goes into a funk, but is saved by his adorable dog and a woman he generously helped when he was riding high in the early 1920s.

The French actor learned to tap dance for the Valentin part, and says his favorite American actor is Paul Newman. In last night?s acceptance comments, Dujardin said Douglas Fairbanks also was an inspiration.

?I haven?t seen 'The Artist' yet. I guess I?m going to go now,? said one manager of a caf? near the Radio France complex in Paris, who gave his name as Fran?ois.

Ironically Dujardin did not win at the Cesars, France's equivalent of the Academy Awards, handed out two days earlier. Paris Match commented wryly that a prophet is never accepted in his own country, and said it took the Oscars to give Dujardin due fame.

Mr. Clooney is a favorite in France and Europe and for a time was a frequent visitor in Paris. He appears as himself in a popular ever-present French coffee advert, saying the name of the coffee and asking coolly, ?What else?? This morning, online media showed Clooney, and next to the words ?what else?? gave the name, ?Jean Dujardin!?

A rare Oscar sweep by France

French cinema and filmmakers are famed for innovating styles like avant garde, film noir, art nouveau, and cin?ma v?rit?. France?s Marion Cotillard won an Oscar for Best Actress in 2008 for her depiction of singer Edith Piaf in La Vie en Rose; Roman Polanski was the first Frenchman to earn Best Director when he won in 2003.

But French silver-screen offerings have never broken through with the kind of sweep seen in this year's Oscars.

The city of Paris also proved last night its ongoing imaginative hold. Mr. Scorsese's ?Hugo? centers on an orphan living in a Paris train station who manages to preserve the creations of French cinema pioneer Georges M?li?s. ?Midnight in Paris? is Mr. Allen?s wry tribute to the bittersweet era of, among others, Ernest Hemingway and the Lost Generation on the Left Bank. It stars Owen Wilson and Ms. Cotillard and has a cameo by Carla Bruni, wife of French president Nicolas Sarkozy.

(Mr. Sarkozy, who faces reelection this spring, issued a post-awards statement commending the ?special vitality of French cinema.?)

Even Steven Spielberg's ?War Horse? is set partly in the frighteningly chaotic Franco-European battlefields of World War I.?
