Court tosses law about false claims on medals

WASHINGTON (AP) ? The Supreme Court on Thursday struck down a federal law making it a crime to lie about receiving the Medal of Honor and other prized military awards, with justices branding the false claim "contemptible" but nonetheless protected by the First Amendment.

The court voted 6-3 in favor of Xavier Alvarez, a former local elected official in California who falsely said he was a decorated war veteran and had pleaded guilty to violating the 2006 law, known as the Stolen Valor Act. The law, enacted when the U.S. was at war in Afghanistan and Iraq, was aimed at people making phony claims of heroism in battle.

The ruling, written by Justice Anthony Kennedy, ordered that the conviction be thrown out.

"Though few might find respondent's statements anything but contemptible, his right to make those statements is protected by the Constitution's guarantee of freedom of speech and expression. The Stolen Valor Act infringes upon speech protected by the First Amendment," Kennedy said.

The high court has in recent years rejected limits on speech. The justices struck down a federal ban on videos showing graphic violence against animals and rejected a state law intended to keep violent video games away from children. The court also turned aside the attempt by the father of a dead Marine to sue fundamentalist church members who staged a mocking protest at his son's funeral. In 1989, the court said the Constitution protects the burning of the American flag.

Justices Samuel Alito, Antonin Scalia and Clarence Thomas dissented in the Alvarez case.

"These lies have no value in and of themselves, and proscribing them does not chill any valuable speech," Alito said. "By holding that the First Amendment nevertheless shields these lies, the court breaks sharply from a long line of cases recognizing that the right to free speech does not protect false statements that inflict real harm and serve no legitimate interest."

Alvarez made his claims by way of introducing himself as an elected member of the Three Valleys Municipal Water District in Pomona, Calif. There is nothing to suggest that he received anything in exchange or that listeners especially believed him.

The government had defended the law as necessary to punish impostors to protect the integrity of military medals.

But Justices Stephen Breyer and Elena Kagan said in a separate opinion that there were ways for the government to stop liars "in less restrictive ways." One possibility would be to "insist upon a showing that the false statement caused a specific harm or at least was material, or focus its coverage on lies most likely to be harmful or on contexts where such lies are most likely to cause harm," Breyer said.

Civil liberties groups, writers, publishers and news media outlets, including The Associated Press, told the justices they worried that the law, and especially the administration's defense of it, could lead to more attempts by government to regulate speech.

Then-Gen. George Washington established military decorations in 1782, seven years before he was elected as the first president. Washington also prescribed severe military punishment for soldiers who purported to be medal winners but weren't.

It long has been a federal crime to wear unearned medals, but mere claims of being decorated were beyond the reach of law enforcement. The Stolen Valor Act aimed to solve that problem, and won significant support in Congress during a time of war.

Alvarez's lawyers challenged the law by acknowledging their client's lies, but also insisting that they harmed no one.

"Statutes suppressing or restricting speech must be judged by the sometimes inconvenient principles of the First Amendment," Kennedy said. "By this measure, the statutory provisions under which respondent was convicted must be held invalid, and his conviction must be set aside."

"We've had several dogs die when the heat index gets this high," Keck said. "If it's dangerous for you, your kids, then it's dangerous for your animals. They have a fur coat on. You've got to keep them cool, you've got to do everything in your power to keep cool or you will be charged with animal cruelty and if that animal dies in your backyard it's on you."

Keck says if she sees a dog in a car or outside without shade and water and depending on the condition of the dog the owner will face punishment.

"We can do as little as a fine for leaving your dog in the car or outside in the heat to a full charge of animal cruelty, which is a class d felony I believe," Keck said.

Dr. Holmes says symptoms of heat stress include heavy panting, bright red gums, the animal is unsteady on its feet, vomiting, and diarrhea. Officer Keck says you should seek medical attention or call authorities if your pet is showing any of these signs because simply giving them water isn't enough to bring their temperature down.

Scientists measure soot particles in flight

ScienceDaily (June 27, 2012) ? "For the first time we can actually see the structure of individual aerosol particles floating in air, their 'native habitat'," said DESY scientist Henry Chapman from the Center for Free-Electron Laser Science (CFEL) in Hamburg. "This will have important implications for various fields from climate modelling to human health." CFEL is a joint venture of Deutsches Elektronen-Synchrotron DESY, the German Max Planck Society and the University of Hamburg.

Aerosol particles like soot play important roles in a wide range of fields from toxicology to climate science. Despite their importance, their properties are surprisingly difficult to measure: Visible light doesn't provide the necessary resolution, X-ray sources are usually not bright enough to image single particles, and for electron microscopy particles have to be collected onto a substrate, which potentially alters their structure and encourages agglomeration.

Using the world's most powerful X-ray laser LCLS at the U.S. SLAC National Accelerator Laboratory in Stanford (California), the team captured images of single soot particles floating through the laser beam. "We now have a richer imaging tool to explore the connections between their toxicity and internal structure," said SLAC's Duane Loh, lead author of the study appearing in this week's scientific journal Nature. Free-electron lasers like LCLS or the European XFEL currently being built in Hamburg consist of particle accelerators that send unbound (free) electrons on a tight slalom course where they emit X-ray light.

The study focused on particles less than 2.5 micrometres in diameter. This is the size range of particles that efficiently transport into the human lungs and constitute the second most important contribution to global warming. Microscopic soot particles were generated with electric sparks from a graphite block and fed with a carrier gas of argon and nitrogen into a device called an aerodynamic lens, that produces a thin beam of air with entrained soot particles. This aerosol beam intercepted the pulsed laser beam. Whenever an X-ray laser pulse hit a soot particle, it produced a characteristic diffraction pattern that was recorded by a detector. From this pattern, the scientists were able to reconstruct the soot particle's structure.

"The structure of soot determines how it scatters light, which is an important part of understanding how the energy of the sun is absorbed by the Earth's atmosphere. This is a key factor in models of the Earth's climate," explained co-author Andrew Martin from DESY. "There also are many links between airborne particles around two micrometres in size and adverse health effects. Using the free-electron laser we are now able to measure the shape and composition of individual airborne particles. This may lead to a better understanding of how these particles interfere with the function of cells in the lungs."

The team recorded patterns from 174 individual soot particles and measured their compactness, using a property called fractal dimension. "We've seen that the fractal dimension is higher than what was thought," said Chapman. "This means that soot in the air is compact, which has implications for the modelling of climate effects." Also, the structure of the airborne soot seems to be surprisingly variable. "There is quite some variation in the fractal dimension, which implies that a lot of rearrangement is going on in the air," explains Chapman.

A primary long-term goal of the research is to take snapshots of airborne particles as they change their size, shape and chemical make-up in response to their environment, explained Michael Bogan from SLAC, who led the research. "Scientists can now imagine being able to watch the evolution of soot formation in combustion engines from their molecular building blocks, or maybe even view the first steps of ice crystal formation in clouds."

In real-world settings soot is seldom pure. To see the effects of mixing with other aerosols, the researchers added salt spray to the soot particles, resulting in larger particles with soot attached to the tiny salt crystals. Such composite particles might form in coastal cities and are expected to have a much larger climate effect than soot alone. Composite aerosols are more difficult to analyse, but the new technique could clearly discern between soot, salt and mixtures of both. As the aerosol particles are vaporized by the intense X-ray laser pulse, the researchers could use mass spectroscopy to examine the composition of each individual particle imaged.

Even though the aerosol particles are destroyed by the X-ray laser pulse, the pulse is so short that it out-runs this destruction. Therefore the diffraction patterns are of high quality and represent the undamaged object. The novel X-ray technique can find wide application to study all sorts of aerosols and can also be extended to resolve the static and dynamic morphology of general ensembles of disordered particles, the researchers state.

"We are now able to study the structure of soot by measuring individual particles in a large ensemble," explains Martin. "Biological samples, like cells and large proteins, have a similar size to the soot particles we studied and also lack a fixed, reproducible structure. In the future it may be possible to extend these techniques beyond aerosols, to study the structural variations in biological systems."

The research team included contributors from SLAC, DESY, Lawrence Berkeley National Laboratory, the Max Planck Institutes, the National Energy Research Scientific Computing Center, Lawrence Livermore National Laboratory, Cornell University, the University of Hamburg, Synchrotron Trieste and Uppsala University. LCLS is supported by DOE's Office of Science.

A multi-national team led by USC with researchers hailing from the U.S., China, Pakistan and Israel has developed a system of transmitting data using twisted beams of light at ultra-high speeds ? up to 2.56 terabits per second.

To put that in perspective, broadband cable (which you probably used to download this) supports up to about 30 megabits per second. The twisted-light system transmits more than 85,000 times more data per second.

Their work might be used to build high-speed satellite communication links, short free-space terrestrial links, or potentially be adapted for use in the fiber optic cables that are used by some Internet service providers.

"You're able to do things with light that you can't do with electricity," said Alan Willner, electrical engineering professor at the USC Viterbi School of Engineering and the corresponding author of an article about the research that was published in Nature Photonics on June 24. "That's the beauty of light; it's a bunch of photons that can be manipulated in many different ways at very high speed."

Willner and his colleagues used beam-twisting "phase holograms" to manipulate eight beams of light so that each one twisted in a DNA-like helical shape as it propagated in free space. Each of the beams had its own individual twist and can be encoded with "1" and "0" data bits, making each an independent data stream ? much like separate channels on your radio.

Their demonstration transmitted the data over open space in a lab, attempting to simulate the sort of communications that might occur between satellites in space. Among the next steps for the research field will be to advance how it could be adapted for use in fiber optics, like those frequently used to transmit data over the Internet.

The team's work builds on research done by Leslie Allen, Anton Zeilinger, Miles Padgett and their colleagues at several European universities.

"We didn't invent the twisting of light, but we took the concept and ramped it up to a terabit-per-second," Willner said. His team included Jian Wang, Jeng-Yuan Yang, Irfan M. Fazal, Nisar Ahmed, Yan Yan, Hao Huang, Yongxiong Ren and Yang Yue from USC; Samuel Dolinar from NASA's Jet Propulsion Laboratory; and Moshe Tur from Tel Aviv University.

Wang, the lead author, left USC after completing this research and is now a professor at the Huazhong University of Science and Technology in China.

Our summer karate camp is a great place for kids to get fit during the summer months!
At our training camp your child will have tons of fun. As part of the curriculum martial arts training is the major focus. Each day will consist of stretching, warm ups, strength drills and Tae Kwon Do training.

At our training camp your child will have tons of fun. As part of the curriculum martial arts training is the major focus. Each day will consist of stretching, warm ups, strength drills and Tae Kwon Do training.

Fun and?Games

To break up the training sessions and to keep focus and concentration at their peek, your child will participate in various games. These games also enhance athletic ability that develop coordination, speed, power, etc. Such games may be: Relay races, dodge-ball, tug of war, indoor baseball, indoor basketball, king of the ring, and many more.

Mental Awareness

In addition to the message of the month, a discussion on mental awareness will also be a part of our camp. Such discussions on drugs, smoking, strangers, your surroundings, avoiding conflicts and peer pressure, leadership qualities, perseverance and many more.

Tae Kwon?Do Training

The Tae?Kwon?Do training will be divided into segments similar to our curriculum for a complete well rounded focus on advancement and improvement. Examples of such segments are: forms, kicks, self-defense, sparring drills, sparring competition, sweeps/throws/ rolls/dives/misc., pad work, kicking, and flying kicks.

Message of the Month

As part of each and every day, we will have a discussion on a message of the month. These messages focus on discipline, respect, proper etiquette, and other mannerisms that are important in self-improvement and developing positive attitudes.

Who Can Participate?

Any student, ages 4-12 that is looking to gain valuable experience and extra practice to drastically improve themselves and abilities.
Any family member or friend of a student, ages 4-12, that is looking for a different kind of summer camp and that may be interested in perusing martial arts training.

Weeks are Monday-Thursdays from 9am-2pm

Snack and Juice will be provided.
Lunch is required everyday except on Thursday?s when there will be Pizza and a Movie.

Mubarak health drama adds to Egypt uncertainty

CAIRO (Reuters) - Hosni Mubarak's transfer to a Cairo military hospital from prison after officials said the ousted leader had suffered a health crisis created a fresh sense of uncertainty for Egyptians as they awaited the result of a weekend presidential poll.

Senior officers and military sources gave various accounts overnight of the 84-year-old Mubarak's condition, including that he was in a coma and on life support. But they said he was not clinically dead, as state media reported for a time on Tuesday.

Mubarak's health has been a subject of frequent speculation since he was jailed for life on June 2, casting his shadow over the political transition and reminding the nation that, 16 months after his fall, few questions have been answered about where Egypt is heading and whether democracy will take root.

The Muslim Brotherhood, the former president's long-time adversary, declared victory for their candidate Mohamed Morsy after a presidential run-off vote on Saturday and Sunday. Rival Ahmed Shafik, a former air force chief like Mubarak and his last prime minister, has challenged the claim and says he is ahead.

But whoever is declared winner - an announcement is due to come on Thursday - the next president's powers have already been curbed in a last-minute decree issued by the ruling generals after they ordered the Islamist-led parliament dissolved.

Reflecting the multiple levels of uncertainty, newspaper headlines pondering the outcome of the presidential vote outcome vied with those reporting the unclear status of the former president's health after his evening transfer from the medical unit of Cairo's Tora prison to the Maadi military hospital.

"Contradiction around the death of Mubarak after he suffers a clot to the brain," wrote Al-Ahram newspaper. Below it the headline read, "Most critical 48 hours in Egypt's history" - a reference to the election committee review of appeals from each candidate over alleged voting violations by the other camp.

"Mubarak in a coma between life and death," wrote Al-Akhbar, below a headline highlighting the row between Morsy and Shafik over who won: "Future president in the realm of the unknown."

A few dozen people gathered outside the hospital overnight.

Some were merely curious bystanders who heard a famous patient had arrived, others congregated in support. One held up a poster of Mubarak, resplendent in ceremonial uniform, with the caption: "History will be the judge."

"Mubarak has been dead since his people sentenced him to prison and threw him in Tora; His people wronged him and did not give him his rights," said Loola Yamany, 50. She was one of a handful of people there on Wednesday morning.

Many Egyptians have been skeptical. Some protested when he was not sentenced to death. Many others suspect fellow officers, who pushed him aside after 30 years to appease the protesters, of conniving to give him a more comfortable confinement.

Mubarak's legal team has been pressing to have him moved from the prison hospital to a better-equipped facility, saying he was not receiving adequate treatment for his condition. However, prison authorities previously refused to let him go.

"The former president's condition is critical after it deteriorated because of a lack of good care and treatment inside the Tora prison hospital, so he was taken to the nearest hospital," Mubarak's defense lawyer Farid al-Deeb told Al-Ahram.

CONFUSION

For most Egyptians, the identity of their next president was a more pressing concern than the fate of their last.

"The news about Mubarak's health is all speculation. We should depend on reality. We can't keep following rumors," said Maher Eid Hemdan, a 59-year-old pensioner, in central Cairo.

"As for the elections, may the right man win."

There has been no clear statement from independent medical experts on what ails Mubarak, though state media have reported a variety of illnesses from shortage of breath to heart attacks.

The state news agency's report that he was "clinically dead", a condition normally defined by the lack of heartbeat and breathing and one from which patients can be revived, was followed by swift denials from military sources. It was unclear whether at any point he had reached that stage, though some sources did say he was dependent on a machine to breathe.

General Said Abbas, a member of the ruling military council, told Reuters that, while Mubarak had suffered a stroke, "any talk of him being clinically dead is nonsense."

Another military source said he was in a coma and on life support, while a third military source described the former leader as "almost stable," without elaborating.

Private television al-Hayat broadcast video which it said was of Mubarak's move. The images showed a patient on a stretcher being transferred from an ambulance into hospital.

Al-Arabiya television said Mubarak's wife Suzanne arrived on Tuesday night at the Maadi facility, where the last shah of Iran died after he was ousted in the 1979 Islamist revolution.

It is also the hospital where Anwar Sadat, Mubarak's predecessor, was declared dead after he was gunned down by Islamists during a military parade in 1981. Mubarak, who was a little remarked vice president at the time, then took charge.

SEIA's Statement: New Brattle Group Report Shows Solar Energy as a Solution in Texas to Help Address Summer Electricity Challenges

Additional solar capacity lowers summer electricity costs and creates a more reliable grid for Texans

As Texas braces for predicted tighter electricity reserves and higher electricity rates in the state this summer, a new report shows that adding solar capacity to the Texas electricity grid would result in lower wholesale electricity prices for Texas customers.

Analysts at The Brattle Group energy consultancy reviewed data from the Texas electricity market from the summer of 2011 and analyzed how prices would have been impacted if solar photovoltaic (PV) systems had been added to the generation mix. Their report concludes that adding photovoltaic solar to the Texas electricity grid in the summer of 2011 could have saved customers an average of $155 to $281 per megawatt hour (MWh) and that avoiding fuel, operations and maintenance costs associated with fossil fuels plans could have saved customers an additional $52/MWh. Taken together, the total customer benefits of adding solar PV to the Texas grid was valued at more than $520 million.

Pat Wood, former chairman of the Public Utility Commission of Texas and of the Federal Energy Regulatory Commission, said solar is a natural fit for Texas? energy capacity problems because solar electricity production peaks during afternoon hours when summer electricity demand is highest.

?Texas needs more on-peak capacity,? Wood said. ?Solar delivers on peak, it doesn't use water and it doesn't create any smog pollution. It is increasingly affordable, competing favorably with other peak-of-the-day resources.?

"Knowing the electricity grid in Texas is strained, I am relieved to see new data. This report provides a simple yet important first look at detailed examples of solar?s impacts. The forthcoming legislative hearings should take note,? said Kip Averitt, Chairman of the Texas Clean Energy Coalition, who formerly served in both the State Senate and House of Representatives.

During last year?s unseasonably hot summer, the Electric Reliability Council of Texas (ERCOT), which operates the Texas electricity grid, was forced to issue six conservation alerts because of record electricity usage in the state, resulting in electricity shutoffs for customers who volunteered for cutbacks during emergency conditions.

Similar capacity issues could occur this summer. According to an analysis released May 30 by the North American Electric Reliability Corporation, Texas electricity reserves ?will challenge operations this summer? because ?resource adequacy levels have fallen below targets.? The analysis also stated that if Texas experiences extreme and prolonged high temperatures, rotating outages are possible this summer.

?The declining cost of solar increasingly makes it a more viable option in Texas, where there is plenty of sun, electricity demand and a looming water shortage,? said Ben Paulos, renewable power program director of the Energy Foundation. ?However, to accelerate deployment, solar needs to be compensated for the value it delivers, through fair market rules.?

Carrie Cullen Hitt, Vice President of State Affairs for the Solar Energy Industries Association, said the double benefit of lower electricity costs and increased reliability makes solar a clear choice for the state.

?This study shows that not only can solar energy help lower costs for Texas, but that adding solar capacity helps address the state?s more urgent crisis of potential rolling blackouts during the hot summer months,? Hitt said. ?The state?s electricity grid was pushed to the brink of failure last summer. As Texas leaders address ways to mitigate this risk and the state?s energy future, solar should be an important part of their plans.?

Former PUC Chairman Wood also emphasized that solar can be brought online more quickly and efficiently to the Texas electricity grid than other electricity sources, which require permitting and building of additional power plants.

?Importantly for us, it is quick to market,? Wood said. ?And in our open market, as this study shows, it drives down peak prices, saving money for all customers."

?Solar energy is clean, produces more peak power when demand is highest and can ensure Texas has a balanced energy portfolio with the least cost,? said Hitt.

The report released today, ?The Potential Impact of Solar PV on Electricity Markets in Texas,? was funded by the Energy Foundation and the Solar Energy Industries Association. The report findings are supported by the Texas Clean Energy Coalition.
